TERMS AND CONDITIONS OF AMW REWITA Sp. z o.o.

Rewita Zakopane Branch

§ 1. SUBJECT OF THE TERMS AND CONDITIONS

  1. The Terms and Conditions of AMW REWITA Sp. z o.o. Rewita Zakopane Branch (hereinafter referred to as the Center Terms and Conditions) define the rules for providing services, responsibility, and staying on the premises of the Rewita Zakopane Branch (hereinafter: Center) and constitute an integral part of the contract concluded through making a reservation, paying the reservation fee, or full payment for the stay at the Center. By performing these actions, the Guest confirms that they have read and accept the terms of the Center's Terms and Conditions.
  2. The Center Terms and Conditions apply to all Guests staying on the premises of the Center.
  3. The Center Terms and Conditions are available for review at the Center Reception and on the website.

§ 2. HOTEL DAY

  1. The room at the Center is rented per hotel day.
  2. The hotel day lasts from 4:00 PM to 10:00 AM the following day.
  3. Failure to leave the room by 10:00 AM will result in charges for an additional day without the possibility of further accommodation.
  4. The Guest should request an extension of the hotel day at the Center Reception in advance. The Center may refuse the extension request, especially if all accommodation places (rooms) are occupied or if Guests do not comply with the Center's Terms and Conditions.
  5. The Center reserves the right to refuse the Guest's stay extension if full payment for the current stay has not been made.

§ 3. RESERVATION AND STAY

  1. The basis for granting the Guest a room is presenting a photo ID to the Center Reception staff and completing a stay card.
  2. The Guest may not allow third parties to use the room, even if the payment period has not expired.
  3. Visitors from outside may visit Guests between 10:00 AM and 8:00 PM, after prior notification to the Center Reception.
  4. The condition for accepting a reservation is the payment of the reservation fee in accordance with the Company's current service reservation regulations.
  5. The Center may refuse service to a Guest who grossly violated the Center Terms and Conditions during a previous stay, particularly by causing damage to the Center's or other Guests' property, injury to the Guest, AMW REWITA Sp. z o.o. employees, or other persons staying at the Center.
  6. The stay price does not include local fees, which the Center is obliged to collect during check-in formalities.

§ 4. SERVICES

  1. If there are complaints regarding the quality of services, the Guest is requested to report them immediately to the Center Reception to allow staff to improve the service standard.
  2. The Center is obliged to provide Guests with:
    • conditions for full and unrestricted rest,
    • safety of stay, including confidentiality of Guest information,
    • professional and courteous service regarding all services provided at the Center,
    • room cleaning and necessary equipment repairs during the Guest's absence, and in the Guest's presence only if consent is given or requested.
  3. Additionally, upon Guest request, the Center provides the following services included in the stay price:
    • providing information related to the stay and travel,
    • wake-up calls at the requested time,
    • storage of money and valuables in the deposit during the Guest's stay, subject to § 6 clause 4 of the Center Terms and Conditions,
    • taxi ordering.
  4. The Center may provide additional services based on separate regulations and price lists.

§ 5. GUESTS' RESPONSIBILITY

  1. Children under 12 years old should be under the constant supervision of legal guardians while on the Center's premises. Legal guardians are financially responsible for any damage caused by children.
  2. The Guest is fully financially responsible for any damages or destruction of the Center's equipment and technical devices caused by themselves or their visitors. The Center reserves the right to charge the Guest for damages after departure.
  3. In the event of violating the Center Terms and Conditions, the Center may refuse to provide services to the offending person. Such a person must promptly comply with the Center's demands, settle outstanding payments for services provided, pay for any damage, and leave the Center.
  4. Each time a Guest leaves a room, for safety reasons, they should turn off the TV, lights, close taps, and lock the door. The key must be left at the Center Reception. For fire safety reasons, the use of heaters and other electrical devices not part of the room equipment is prohibited in rooms and other premises. This does not apply to chargers and power supplies for computer equipment. Any remarks, suggestions, defects in Center equipment, or malfunctioning devices noticed by Guests should be reported to the Center Reception.

§ 6. CENTER'S RESPONSIBILITY

  1. The Center is responsible for the loss or damage of items brought by persons using its services within the scope defined by the Civil Code regulations (Art. 846 and following).
  2. The Guest should notify the Center Reception of any damage immediately after its occurrence.
  3. The Center is responsible for the loss or damage of money, securities, valuables, or items of scientific or artistic value only if these items have been deposited in the deposit box.
  4. The Center reserves the right to refuse acceptance of highly valuable items, large amounts of money, items threatening safety, and large-sized items that cannot be stored in the deposit box.
  5. The Center is not responsible for damage or loss of a car or other vehicle belonging to the Guest, items left inside it, or live animals, regardless of whether the vehicles are parked on the Center's premises or elsewhere.
  6. The Center is not responsible for items left in publicly accessible places on the Center's premises.

§ 7. RETURN OF LEFT ITEMS

  1. Personal items left in the room by a departing Guest will be sent to the address provided by the Guest at the Guest's expense.
  2. If no instructions for the return of items are received from the Guest, the Center will store these items at the owner's expense for three months, after which the items will become the Center's property.

§ 8. NIGHT QUIET

Quiet hours at the Center are from 10:00 PM to 7:00 AM.

§ 9. COMPLAINTS

  1. Guests have the right to file complaints if they notice deficiencies in the quality of services provided.
  2. All complaints are accepted at the Center Reception.
  3. Complaints should be submitted in writing immediately after noticing deficiencies in the service standard.

§ 10. ADDITIONAL PROVISIONS

  1. The Center does not accept the presence of animals.
  2. Smoking tobacco and using open flames is strictly prohibited in all Center facilities and their immediate surroundings, except in designated areas. The Guest responsible for any Fire Brigade interventions due to non-compliance will be charged for the intervention costs. Additionally, non-compliance may result in the Guest being charged for room disinfection costs.
  3. It is forbidden to store hazardous materials in Center rooms – weapons and ammunition, flammable, explosive, and illuminant materials.
  4. Open fires and barbecues are strictly prohibited on the Center's premises.
  5. Electric and gas stoves are strictly prohibited in the Center.
  6. The Center reserves the right to move the Guest to another room (room swap), maintaining the principle of no deterioration in stay conditions (same or better standard) due to failures, repairs, accidents, or booking errors.
  7. The Center does not refund payments if the Guest shortens the reserved stay. In case of shortening the stay before full settlement, the Center charges 30% of the reservation fee for each unused day.

§ 11. PERSONAL DATA

  1. The personal data administrator is: AMW REWITA Sp. z o.o. with its registered office in Warsaw, ul. Zielone Zacisze 11B, 03-294 Warsaw.
  2. Contact with the Data Protection Officer is possible at: iod@rewita.pl.
  3. Personal data is processed for the purpose of:
    1. planning and managing service realization, processing payments, performing accounting, audit, settlement, and debt collection activities;
    2. handling potential complaints and providing ordered services;
    3. resolving disputes, enforcing contracts, and asserting or defending claims;
    4. ensuring compliance with legal requirements, e.g., maintaining sales documentation for tax purposes or sending notifications and other legally required information.
  4. In cases where consent has been given, personal data is also processed for receiving offers, other service-related information (including marketing newsletters), and information about planned events.
  5. Personal data will not be processed for automated decision-making or profiling beyond the scope described above.
  6. Personal data is processed based on Article 6 of the General Data Protection Regulation of 27 April 2016 (EU Official Journal L 119 of 04.05.2016), which states processing is necessary for the performance or fulfillment of legal obligations of the Company or necessary for the Company's legitimate interests, provided that the Guest's interests or fundamental rights and freedoms do not prevail; processing may also be based on Guest consent if explicitly given.
  7. The following categories of personal data are collected and processed in particular:
    1. Contact information – such as full name, address, phone number, email address;
    2. Payment data – such as necessary data for processing payments and fraud prevention, including credit and debit card numbers, security codes, and other billing-related information;
    3. Special categories of Personal Data – related to SPA services and access to certain wellness facilities; we may request health information. Consent is the basis for using such information; lack of consent may prevent the use of certain treatments;
    4. Other Personal Data – occasionally, we may request information such as date of birth, habits, or preferences to send greeting messages; consent is the basis for using such information.
  8. Recipients of personal data will be only entities entitled to obtain personal data under the law and entities involved in service delivery.
  9. Personal data will not be processed in third countries.
  10. Personal data will be stored for 10 years.
  11. Subject to certain legal conditions, the Guest has the right to access personal data and correct or delete it, as well as restrict processing. The Guest also has the right to object to processing and request data transfer. In particular, the Guest has the right to request copies of personal data, and the Company may charge a fee for multiple copies. Consent to personal data processing can be withdrawn at any time with future effect; withdrawal does not affect the lawfulness of processing based on consent before withdrawal. Data may still be processed on other legal grounds after withdrawal.
  12. The Guest has the right to file a complaint with the supervisory authority.
  13. Providing personal data is voluntary; however, refusal to provide data may result in refusal to provide the service/contract.
