TERMS AND CONDITIONS OF AMW REWITA Sp. z o.o.

Rewita Sopot Branch

§ 1. SUBJECT OF THE TERMS AND CONDITIONS

  1. The Terms and Conditions of AMW REWITA Sp. z o.o. Rewita Sopot Branch (hereinafter referred to as the Facility's Terms and Conditions) define the rules for providing services, responsibilities, and staying on the premises of the Rewita Sopot Branch (hereinafter: Facility) and constitute an integral part of the contract concluded by making a reservation, paying the reservation fee or the full amount for the stay at the Facility. By performing the aforementioned actions, the Guest confirms that they have read and accept the terms of the Facility's Terms and Conditions.
  2. The Facility's Terms and Conditions apply to all Guests staying on the Facility's premises.
  3. The Facility's Terms and Conditions are available for inspection at the Facility's Reception and on the website.

§ 2. HOTEL DAY

  1. The room in the Facility is rented for hotel days.
  2. The hotel day runs from 4:00 PM to 11:00 AM the following day.
  3. Failure to vacate the room by 11:00 AM results in charging fees for the next day without the possibility of further accommodation.
  4. The Guest should request an extension of the hotel day in advance at the Facility's Reception. The Facility may refuse the request for extension, especially when all accommodation places (rooms) are occupied or if Guests do not comply with the Facility's Terms and Conditions.
  5. The Facility reserves the right to refuse to extend a Guest’s stay in case of non-payment of the full amount for the current stay.

§ 3. RESERVATION AND STAY

  1. The basis for granting a Guest access to a room is presenting a photo ID to the Facility Reception employee and completing a stay registration card.
  2. The Guest may not make the room available to third parties, even if the period paid for has not expired.
  3. Visitors from outside may visit Guests between 10:00 AM and 8:00 PM after prior notification to the Facility Reception. 4. The condition for accepting a reservation is the payment of a reservation fee according to the Company's regulations on service reservations. 5. The Facility may refuse service to a Guest who grossly violated the Facility's Terms and Conditions during a previous stay, particularly by damaging the Facility’s property or property of other Guests, causing harm to a Guest, employees of AMW REWITA Sp. z o.o. or other persons on the Facility’s premises. 6. The price of the stay does not include local fees collected by the Facility during registration procedures.

§4. SERVICES

  1. In case of any complaints regarding the quality of services, the Guest should report them immediately to the Facility Reception, allowing staff to improve the quality of provided services.
  2. The Facility is obligated to ensure Guests:< ul>
  3. conditions for full and unrestricted relaxation,
  4. safety during the stay, including confidentiality of Guest information,
  5. professional and courteous service in all services provided at the Facility,
  6. room cleaning and necessary repairs of devices during the Guest’s absence, and in their presence only if consented or requested.
  7. Additionally, upon the Guest’s request, the Facility provides the following services included in the price of stay:< ul>
  8. providing information related to stay and travel,
  9. wake-up calls,
  10. storage of money and valuables in deposit during the Guest’s stay with the reservation of § 6 sec. 4 of the Facility's Terms and Conditions,
  11. taxi ordering.
  12. The Facility may provide additional services based on separate regulations and price lists.

§ 5. RESPONSIBILITY OF GUESTS

  1. Children under 12 years old must be under the constant supervision of legal guardians on the Facility's premises. Legal guardians bear material responsibility for any damage caused by children.
  2. The Guest bears full material responsibility for any damages or destruction of the Facility’s equipment and technical devices caused by themselves or visitors. The Facility reserves the right to charge the Guest for damages after their departure.
  3. In case of violation of the Facility's Terms and Conditions, the Facility may refuse service to the person violating them. Such person is obliged to comply immediately with the Facility’s requests, settle payments for services received so far, pay for any damages, and leave the Facility.
  4. Each time leaving the room, for safety reasons, the Guest should turn off the TV, switch off the lights, turn off faucets, and lock the door. The key/card should be left at the Facility Reception. For fire safety reasons, the use of heaters and other electrical devices not provided as room equipment is prohibited in rooms and other areas. This does not apply to chargers and power supplies for computer equipment. All remarks, proposals, defects in the Facility’s equipment, and malfunctions noticed by Guests should be reported to the Facility Reception.

§ 6. RESPONSIBILITY OF THE FACILITY

  1. The Facility is responsible for loss or damage of items brought onto its premises by service users to the extent defined by the Civil Code (Art. 846 and following).
  2. The Guest should notify the Facility Reception immediately after discovering a damage.
  3. The Facility is liable for loss or damage of money, securities, valuables, or items with scientific or artistic value only if such items have been deposited in the deposit box.
  4. The Facility reserves the right to refuse acceptance of items of high value, large sums of money, items threatening safety, or oversized items that cannot be placed in the deposit box.
  5. The Facility is not responsible for damage or loss of the Guest’s car or other vehicle, items left in vehicles, or live animals, regardless of whether the vehicles are parked on the Facility’s parking or outside.
  6. The Facility is not responsible for items left in public areas on the Facility's premises.

§ 7. RETURN OF LEFT ITEMS

  1. Personal items left in the room by the departing Guest will be sent to the Guest’s indicated address at their expense.
  2. If no return instructions are received from the Guest, the Facility will store the items at the owner’s expense for three months, after which the items will become the property of the Facility.

§ 8. QUIET HOURS

Quiet hours at the Facility are from 10:00 PM to 7:00 AM, excluding special events.

§9. COMPLAINTS

  1. Guests have the right to file complaints in case of noticing deficiencies in the quality of services provided.
  2. All complaints are accepted by the Facility Reception.
  3. Complaints should be submitted in writing immediately after noticing shortcomings in service quality.

§ 10. ADDITIONAL PROVISIONS

  1. The Facility does not accept animals.
  2. A complete ban on smoking and open fire is in force in all Facility buildings and immediate vicinity, except designated areas. Guests causing fire brigade interventions due to disobedience will be charged for the costs. In addition, Guests may be charged for room disinfection costs due to tobacco smoking violation.
  3. The storage of hazardous loads – weapons and ammunition, flammable, explosive, and illuminating materials – is prohibited in Facility rooms.
  4. The use of electric and gas stoves is strictly prohibited in the Facility.
  5. The Facility reserves the right to move a Guest to another room (room exchange) adhering to the rule of no downgrade in stay conditions (same or better standard) due to failures, renovations, unforeseen events, or booking errors. The Facility does not categorize rooms based on Bay view.
  6. The Guest is obliged to pay for the entire stay 7 days before arrival. In special cases, with the Facility Director’s consent, payment can be made on the day of arrival at the latest.
  7. The Facility does not refund payments made if the Guest shortens the reserved stay. In case of early departure before final settlement, 30% of the value of each unused day will be charged from the reservation fee.

§ 11. PERSONAL DATA

  1. The data controller is: AMW REWITA Sp. z o.o. based in Warsaw, ul. Zielone Zacisze 11B, 03-294 Warsaw.
  2. Contact with the Data Protection Officer is possible at: iod@rewita.pl.
  3. Personal data is processed for the purposes of:
    1. planning and managing service provision, processing payments, carrying out accounting, auditing, billing, and debt collection activities;
    2. handling any complaints and providing ordered services;
    3. resolving disputes, enforcing contracts, and establishing claims’ validity, raising or defending claims;
    4. ensuring compliance with legal requirements, e.g., sales documentation for tax purposes or sending notifications and other information as required by law.
  4. Where consent has been given, personal data is also processed to receive offers, other service-related information (including marketing newsletters), and information about planned events.
  5. Personal data will not be processed for automated decision-making or profiling beyond the scope described above.
  6. Personal data processing is based on Article 6 of the General Data Protection Regulation (GDPR) of April 27, 2016 (Official Journal of the EU L 119 of 04.05.2016), according to which processing is necessary for contract performance or legal obligations, or is necessary for the legitimate interest of the Company, provided that the Guest’s fundamental rights do not prevail; processing may also be based on the Guest's explicit consent.
  7. The following categories of personal data are collected and processed:
    1. Contact information – such as full name, address, phone number, email;
    2. Payment data – such as necessary data for payment processing and fraud prevention, including credit/debit card numbers, security codes, and billing-related information;
    3. Special categories of Personal Data – related to provision of SPA services and access to certain spa facilities, we may request health information. Consent is the basis for use of such information; refusal may prevent use of some treatments;
    4. Other Personal Data – occasionally, we may request date of birth, habits, or preferences to send greetings; consent is the basis for use of such information.
  8. Recipients of personal data are only entities authorized by law or participating in service provision.
  9. Personal data will not be processed in third countries.
  10. Personal data will be stored for 10 years.
  11. Subject to legal conditions, Guests have the right to access, rectify or delete, and restrict processing of their personal data. Guests have the right to object and request data portability. They may request a copy of their personal data, but repeated requests may be subject to a fee. Consent for data processing may be withdrawn at any time with future effect; withdrawal does not affect the lawfulness of processing before withdrawal. Processing may continue on other legal grounds if applicable.
  12. Guests have the right to lodge a complaint with the supervisory authority.
  13. Providing personal data is voluntary; refusal may result in refusal to provide services or contracts.
